At Focus Industries Inc. it is a priority to safeguard any information provided by our employees and customers. We are committed to meeting the requirements of all applicable privacy legislation that relates to our company.

This Privacy Policy has been adapted from the 10 principles of the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA).

Principle 1 - Accountability

  • Focus Industries Inc. shall be responsible for protecting personal information in its possession.

  • Focus Industries Inc. shall use suitable means of protection if information provided to us is being processed by a third party, on our behalf.

  • Focus Industries Inc. shall designate a Privacy Officer who is responsible for the organization’s compliance with the principles set out in this Privacy Policy.

  • The Privacy Officer shall implement policies and practices to give effect to these principles.

Principle 2 - Identifying Purposes

  • Focus Industries Inc. shall identify and specify, either orally or in writing, the purposes for which personal information is being collected, at the time it is collected.

  • Focus Industries Inc. shall limit the collection of personal information to what is necessary for the purposes that have been identified.

  • When personal information that has been collected is to be used for a purpose not previously identified, the new purpose shall be identified prior to its use, and the consent of the individual shall be obtained before the information is used.

Principle 3 - Consent

  • The knowledge and consent of an individual shall be obtained either verbally or in writing for the collection, use, or disclosure of personal information.

NOTE: In certain circumstances personal information can be collected, used, or disclosed without the knowledge and consent of the individual. For example, legal, medical, or security reasons may make it impossible or impractical to seek consent.

  • Focus Industries Inc. shall not, as a condition of the supply of a product or service, require an individual to consent to the collection, use, or disclosure of information beyond that required to fulfill the identified, legitimate purposes.

  • An individual may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Focus Industries Inc. shall inform the individual of the implications of such withdrawal.

Principle 4 - Limiting Collection

  • The collection of personal information shall be limited to that which is necessary for the purposes identified by Focus Industries Inc. Information shall be collected by fair and lawful means.

  • Focus Industries Inc. shall not collect personal information indiscriminately.

  • Focus Industries Inc. collects personal information primarily from its customers and employees, but may also collect personal information from other sources including, but not limited to, credit bureaus, employers, or personal references.

Principle 5 - Limiting Use, Disclosure, and Retention

  • Personal information shall not be used or disclosed for purposes other than those for which it was collected, except with the consent of the individual or as required by law.

  • Personal information shall be retained only as long as necessary for the fulfillment of those purposes.

  • Personal Information that is no longer required to fulfill the identified purposes shall be destroyed, erased, or made anonymous.

Principle 6 - Accuracy

  • Focus Industries Inc. shall ensure that personal information is as accurate, complete, and up-to-date as possible for the purposes for which it is to be used.

Principle 7 - Safeguards

  • Focus Industries Inc. shall ensure that all necessary measures are taken to protect personal information under its control.

  • The nature of security (i.e. locks on filing cabinets, passwords, etc.) shall depend on the sensitivity of the information, the amount, distribution, and format of the information, and the method of storage.

  • Focus Industries Inc. shall make their employees aware of the importance of maintaining the confidentiality of personal information.

  • Care shall be used in the disposal or destruction of personal information to prevent unauthorized parties from gaining access to the information.

Principle 8 - Openness

  • Focus Industries Inc. shall be open about their polices and practices and will make readily available to individuals specific information about its policies and practices relating to the management of personal information.

Principle 9 - Individual Access

  • Upon request, an individual shall be informed of the existence, use, and disclosure of his or her personal information and shall be given access to that information.

NOTE: In certain situations, Focus Industries Inc. may not be able to provide access to all the personal information it holds about an individual. The reason for denying access will be provided to the individual upon request. Exceptions may include information that is prohibitively costly to provide, information that contains references to other individuals, information that cannot be disclosed for legal, security, or commercial proprietary reasons, and information that is subject to solicitor-client or litigation privilege.

  • When providing an account of third parties to which it has disclosed personal information about an individual, Focus Industries Inc. shall attempt to be as specific as possible.

  • Focus Industries Inc. shall respond to an individual’s request within a reasonable time.

  • An individual shall be able to challenge the accuracy and completeness of the information and have it amended as appropriate.
